European Anti-discrimination Law Review Issue 18

LR18 Final.pdf - Adobe Reader

The eighteenth edition of the bi-annual European Anti-Discrimination Law Review, available in English has been published.

The Law Review provides two in-depth analytical articles as well as an overview of the latest developments in European anti-discrimination law and policy, reflecting as far as possible the state of affairs as of 15 January 2014.

In this issue:

  • Duty in the United Kingdom to have due regard to equality by Barbara Cohen

The article presents and analyses the regulatory frameworks and the application in the United Kingdom of the duty imposed on public authorities to have ‘due regard’ to equality. The development of this duty since its conception provides interesting insight into the functioning of a pro-active equality policy.

  • The concept of discrimination by association and its application in the Member States by Constantina Karagiorgi

The article provides an exhaustive comparative analysis of the extent to which discrimination by association is prohibited in the countries covered by the Network, whether on the ground of disability or on any other ground covered by the EU anti-discrimination Directives. This overview provides information not only regarding the national regulatory frameworks but also regarding their application and interpretation by national courts.

  • Court of Justice of the European Union Case Law Update
  • European Court of Human Rights Case Law Update
  • European Committee of Social Rights Update
  • National Legal Developments
