As a trained volunteer rescuer with the Emergency Response Centre International (ERCI), Se\u00e1n worked to prevent drownings and offer lifesaving assistance within European waters.<\/p>\n<p>He returns to court facing a series of extremely serious charges &#8211; including membership in a criminal organisation, money laundering, and smuggling, alongside <strong>23 other defendants<\/strong>. If convicted, Se\u00e1n could face <strong>up to 25 years in prison<\/strong>.<\/p>\n<p>His case is one of the largest and most symbolic examples of the <strong>criminalisation of solidarity<\/strong> in Europe today. It sends a chilling message: that offering humanitarian help can be met not with gratitude, but prosecution.<\/p>\n<p><strong>A Wider Pattern: Why Se\u00e1n\u2019s Case Is Not an Isolated One<\/strong><\/p>\n<p>Se\u00e1n\u2019s situation reflects a broader and increasingly systematic trend across Europe. Volunteers, human rights defenders, rescue crews, journalists, ordinary citizens, even mayors and family members have been targeted simply for helping migrants and refugees.<\/p>\n<p>MPG has been documenting this pattern for years &#8211; and the numbers are stark.<\/p>\n<ul>\n<li>In <strong>2018<\/strong>, MPG helped launch the European Citizens\u2019 Initiative <em>\u201cWe Are a Welcoming Europe \u2013 Let Us Help,\u201d<\/em> uniting over 200 organisations and thousands of citizens in calling for an end to the criminalisation of humanitarian assistance.<\/li>\n<li>Through the <strong><a href=\"https:\/\/www.migpolgroup.com\/index.php\/portfolio-item\/resoma\/\">ReSOMA project<\/a><\/strong>, MPG collected extensive data showing a sharp escalation in prosecutions between <strong>2015 and 2019<\/strong>.<br \/>\nBy December 2019, at least <strong>171 individuals<\/strong> had been criminalised in <strong>13 European countries<\/strong> &#8211; including Belgium, France, Greece, Italy, Germany, the Netherlands, Norway, Spain, Switzerland, and the UK.<br \/>\nAnd this increase happened <strong>despite irregular arrivals to the EU dropping by nearly 90%<\/strong> during the same period.<\/li>\n<\/ul>\n<p>This is not about managing migration. It is about punishing solidarity.<\/p>\n<p><strong>What MPG Calls For<\/strong><\/p>\n<p>MPG stands firmly with Se\u00e1n, his co-defendants, and all humanitarian actors who choose compassion over fear.<\/p>\n<p>We call for:<\/p>\n<ol>\n<li><strong> An immediate end to the criminalisation of solidarity<\/strong><\/li>\n<\/ol>\n<p>Saving lives is not &#8211; and must never become &#8211; a crime.<\/p>\n<ol start=\"2\">\n<li><strong> Dropping the charges and freeing Se\u00e1n and the other humanitarians<\/strong><\/li>\n<\/ol>\n<p>Their prosecution contradicts European and international human rights principles.<\/p>\n<ol start=\"3\">\n<li><strong> A revision of the EU Facilitation Directive<\/strong><\/li>\n<\/ol>\n<p>MPG urges EU institutions to <strong>make the humanitarian exemption clause mandatory<\/strong>, ensuring Member States cannot misuse \u201csmuggling\u201d legislation to target volunteers and NGOs.[\/vc_column_text][\/vc_column_inner][\/vc_row_inner][\/vc_column][vc_column][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]\n<h2><span style=\"font-family: Ubuntu;\">About the Migration Policy Group (MPG)<\/span><\/h2>\n<p><span style=\"font-family: Ubuntu;\">MPG is an independent think-and-do-tank based in Brussels.
