MPG Statement on the European Commission’s Proposal to Revise the Return Directive

As tomorrow the European Commission prepares to unveil its proposed revisions to the Return Directive, MPG recommends adopting a holistic and human-rights-based approach to return policies. Our research highlights key principles that must guide any fair and effective return process:

  • Comprehensive Assistance: Returnees must receive both pre- and post-return support, including clear information on their rights, legal aid, and material and financial assistance for reintegration.
  • Detention as a Last Resort: Any use of detention should be strictly necessary and proportionate, ensuring that alternatives are prioritised.
  • Human Rights Protections: Robust safeguards and independent monitoring mechanisms must be in place to prevent human rights violations.
  • Alternatives to Return: Return decisions should be assessed on a case-by-case basis, considering individual, family, and labour market needs, and providing regularisation pathways where appropriate.
  • Stakeholder Involvement: Civil society organisations, including NGOs, human rights groups, and migrant organisations, must be actively involved in the return process to ensure transparency and accountability.

MPG will continue to monitor and assess EU Member States’ adherence to these key dimensions through the Migrant Return Policy Index (MIREX). Given the lack of common standards across the EU, we are particularly concerned that the externalisation of returns through so-called “return hubs” could heighten human rights risks.

We urge EU policymakers to ensure that return policies uphold fundamental rights, prioritise dignity, and reflect a balanced, evidence-based approach.
